Terms & Conditions

1. Definitions

Consciously Forward refers to the business providing coaching, training, and consulting services, represented by Zaitoon Shah.

Client refers to any individual or legal entity entering into an agreement with Consciously Forward.

Services refer to all coaching, training, workshops, consulting, guidance, and related services provided by Consciously Forward.

2. Applicability
  1. These Terms and Conditions apply to all quotations, agreements, and services provided by Consciously Forward.

  2. Any deviations from these Terms and Conditions must be agreed upon in writing.

  3. Any terms and conditions of the Client are excluded unless expressly agreed otherwise in writing.

3. Services
  1. Consciously Forward will perform its services with reasonable skill, care, and professionalism.

  2. Coaching and consulting services constitute an obligation of effort, not a guarantee of specific results.

  3. Outcomes depend on various factors, including the Client's commitment, participation, and implementation.

4. Quotations and Agreements
  1. All quotations are non-binding unless stated otherwise.

  2. An agreement is formed when a quotation is accepted in writing or when Consciously Forward begins delivering services.

  3. Consciously Forward reserves the right to decline assignments without stating reasons.

5. Fees and Payment
  1. All fees are exclusive of VAT unless otherwise stated.

  2. Invoices must be paid within 14 days of the invoice date.

  3. Late payments may be subject to statutory interest and collection costs.

  4. Consciously Forward reserves the right to suspend services until outstanding payments are settled.

6. Cancellation and Rescheduling
  1. Individual coaching sessions may be cancelled or rescheduled free of charge up to 24 hours before the scheduled appointment.

  2. Cancellations made less than 24 hours before the appointment, or failure to attend, may result in the full session fee being charged.

  3. Separate cancellation terms may apply to workshops, training programs, or coaching packages.

  4. Consciously Forward reserves the right to reschedule appointments due to unforeseen circumstances.

7. Client Responsibilities
  1. The Client shall provide all information reasonably necessary for the provision of services.

  2. The Client is responsible for the accuracy and completeness of the information provided.

  3. Participation in coaching is voluntary, and the Client remains responsible for their own decisions, actions, and results.

8. Confidentiality
  1. Consciously Forward will treat all confidential information obtained during the course of services with care and discretion.

  2. Confidential information will not be disclosed unless:

    • the Client has given permission;

    • disclosure is required by law.

9. Intellectual Property
  1. All materials, methodologies, documents, presentations, and content provided by Consciously Forward remain its intellectual property unless otherwise agreed in writing.

  2. Such materials may not be copied, distributed, published, or used commercially without prior written consent.

10. Liability
  1. Consciously Forward's liability is limited to direct damages resulting from gross negligence or intentional misconduct.

  2. Any liability shall be limited to the amount invoiced for the relevant services.

  3. Consciously Forward shall not be liable for indirect damages, consequential losses, lost profits, business interruption, or non-material damages.

  4. The Client remains fully responsible for their own decisions, actions, and outcomes.

11. Force Majeure

Consciously Forward shall not be liable for failure to perform obligations due to circumstances beyond its reasonable control, including illness, technical failures, government measures, natural disasters, pandemics, or other force majeure events.

12. Privacy

Personal data is processed in accordance with the Consciously Forward Privacy Policy.

13. Complaints

Any complaints regarding services should be submitted in writing within 14 days of the event giving rise to the complaint. Consciously Forward will make reasonable efforts to address complaints promptly and fairly.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Netherlands.

Any disputes shall be submitted to the competent courts of the Netherlands.
